| I. Where the fee is not listed in this schedule, the fee shall be determined by the Development Officer and shall be consistent with those fees listed in the fee schedule for similar uses and developments within the same or similar use class. |

| J Where development occurs before the issuance of a development permit, the Development Officer is authorized to charge four times the amount of the application fee on an individual’s or company’s first violation and on second and subsequent violations, the fee is to be those prescribed in the Land Use By-law under the Section “Penalties and Fines”. |

| K. Where a development agreement is required as a condition of a development permit or a subdivision application approval, all associated costs of the preparation, including the removal of the caveat when all conditions of the development agreement are met, shall be the responsibility of the applicant. |

L. Where a development or subdivision occurs within an area in which the municipality adopted an area structure plan, an additional fee shall be applied to a development permit or subdivision application fee if indicated in the area structure plan. |
